Terms of Service

By accessing or using Hearthstone Ed (the "Service"), operated by Broodlaw Ventures ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Broodlaw Ventures. Please read them carefully before using the Service.

• Age Requirement: You must be at least 18 years old to create an account. By registering, you represent that you are at least 18 years of age.
• Parental Accounts:As a parent or guardian, you are responsible for all student accounts and data created under your family account. You manage your children's information and educational records.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately of any unauthorized access to your account.
• Accurate Information: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
• One Account Per Person: Each individual may maintain only one account. Accounts are non-transferable.

Billing

• Subscriptions are billed on a recurring basis (monthly or annually) as selected at the time of purchase.
• All fees are in US dollars and are non-refundable except as described below.
• Payment is processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation

• You may cancel your subscription at any time from your account settings.
• Upon cancellation, you retain access to the Service through the end of your current billing period.
• Your data will be preserved for 30 days after your subscription ends, after which it may be deleted.

Refund Policy

• 14-Day Guarantee: If you cancel within 14 days of your initial subscription or a renewal, you are eligible for a prorated refund of the unused portion.

• Refunds are processed within 5-10 business days to the original payment method.

Price Changes

We reserve the right to change subscription pricing. You will receive at least 30 days' notice before any price change takes effect on your account.

You agree not to:

• Share your account credentials or allow others to access your account
• Use the Service for any unlawful purpose or in violation of these Terms
• Abuse, exploit, or misuse the AI features, including attempting to generate harmful, misleading, or inappropriate content
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use automated tools (bots, scrapers) to access the Service without our written consent
• Interfere with or disrupt the integrity or performance of the Service
• Upload malicious content, viruses, or other harmful material
• Impersonate any person or entity or misrepresent your affiliation

We reserve the right to suspend or terminate accounts that violate these terms at our sole discretion.

Hearthstone Ed includes AI-powered features, including tutoring, coaching, and educational content generation. Please understand:

• Assistive Tool: AI features are designed to assist and supplement your homeschool education. They are not a replacement for professional educational advice, curriculum review, or certified teaching.
• No Guarantee of Accuracy: While we strive for high-quality AI responses, AI-generated content may contain errors. Parents should review and verify AI-generated educational content.
• Parental Oversight:Parents are responsible for overseeing their children's interactions with AI features and ensuring the content is appropriate.
• Not Professional Advice: AI-generated compliance guidance is informational only and does not constitute legal advice. Always verify state requirements through official sources.

Your Data

• You own your data. All student records, portfolios, curriculum plans, and educational content you create remain your property.
• You grant us a limited license to use your data solely to provide and improve the Service.
• You may export or delete your data at any time.

Our Platform

• The Service, including its design, code, features, branding, and documentation, is owned by Broodlaw Ventures and protected by intellectual property laws.
• You may not copy, modify, distribute, or create derivative works of any part of the Service without our written consent.

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• In no event shall Broodlaw Ventures be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.
• Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
• We are not responsible for any decisions made based on AI-generated content or compliance guidance provided through the Service.

• By You: You may terminate your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately at the end of your current billing period.
• By Us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees. We will provide reasonable notice when possible.
• Data After Termination: Upon account termination, your data will be retained for 30 days to allow for export, after which it will be permanently deleted.

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Virginia.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you by email at least 30 days before material changes take effect
• Post a prominent notice on the Service

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
